Shepard is a commander because commander is a rank that is shaed between navy operators and ground troops (marines) in the Mass Effect universe. I'm guessing that, with the flag ranks, Generals focus on ground operations and Admirals focus on ship to ship combat.
However, because the marines are a special subset of the navy, it's easy to move between the two. Some marines likely opt to go into shipboard operations at some point, meaning that they become "Captains" and eventually admirals. Given how rough gound combat can be, this could actually be understandable.
Navy and marines likely also share at least some general training, so there's probably an ability to share tasks - though I suspect it's more likely to see marines sharing navy tasks than navy sharing marine tasks (I suspect the marines, as a special sub-division, get special training in ground warfare).
As for Shepard being XO at the start of ME1, I'm going to say he is given the XO position on the Normandy because:
A) He's special forces and on a special assignment
and
I'm going to again invoke EA, though, to say that the whole argument is moot. ME is EA's franchise, and they clearly refer to Shepard as an "Alliance marine."
