Yea, no. The company has your installed software for proof.

As a final point, as far as I'm aware it's illegal to bind someone to something by simply telling them "by reading you agree".

If you clicked "Agree" when installing the product LEGALLY, that is proof. If you did not click "Agree" when installing, but still managed to have it, you did so illegally. Simple as that.

And this is why EULAs aren´t binding. Because that´s what they do. You HAVE to agree, or your software, for which you spent a lot of money, is useless.

It's not YOUR software. It never will be YOUR software. You spent money on a license, and if you don't agree with the EULA (there's a specific clause which states exactly this) you can take it back to the store and get your money back. By installing the software you are legally bound to obey the rules layed forward by the EULA.

To me EULA make as much sense as this guy does.

Lemme spell things out:
You buy a game
you take it home
you start the installer
you read the EULA
->Agree -> install
->Disagree-> game back to store, money back.

This is true and i didn´t said anything about it. I have no problem with the Battle.net, however i might get one with version 2 because of the Eula. If i ever use it, i have already canceled my SC2 preorder anyways and have no intention for another mindless grindfest in WoW.

I have some older games when they came up with all kinds of protections, but they were all patched afterwards and removed and i guess i was also lucky to not have problems with these, not even with the very controversial TAGES DRM.

What however really pisses me off (sorry for the foul language) is when game devs try to tell me when i have to be online or not and/or force me to install 3th party software.

My girlfriend had the great idea to buy me Dawn of War 2, that wannabe RTS games forces you to have steam and windows live for games. That´s the worst form of DRM for me personaly, it´s also the only game i have with this kind of protection and i can honestly say i will never ever buy a game that forces me to be online all the time.

You can't use a car without signing the damned purchase contract first, isn't that unfair?
