The American legal system is as confusing to me as the American health system... (and yes, I would have been first against the wall when the red scare was on).

I suppose it does serve to make the person invoking their Fifth seem guilty but legally they're not admitting to anything and if they don't actually say anything then you can't really convict them on that (although in the Red Scare those that did were accused of being 'fifth amendment communists' and lost their jobs anyway). The fifth amendment isn't just about not testifying against yourself, though, and it was definitely helpful in overturning confessions obtained by torture (which, while not legal, happened anyway) and other coercive measures like threats and not understanding what your rights are.

To think that Ferderalists thought the Bill of Rights were 'unnecessary'...Posted Image

"No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."

You can totally skew an invocation of the amendment to mean you were invoking the underlined bit. The American legal system is so screwy... I love it bunches... like honey bunches of oats.

Thanks for the explanations - I've never read the whole amendment, and I see your point cave.



We don't have a Bill of Rights. We have common law - and by common law we're not allowed to incriminate ourselves either - I believe (I'm not entirely certain) that it's the other way around - if you're under prosecution the prosecutor isn't allowed to ask the accused anything that might incriminate them.



The argument against having one is that there's always the possibility of omission - who decides what rights are necessary and who decides which aren't? If we make them concrete we always know which aren't as well as which are. And times change, they need to be mutable - there's talk of the internet being a "basic human right" these days. I suppose you can work these things into the existing rights though.



We're a bit "it's not broken so don't fix it" here. Until there's a massive abuse of human rights (some would argue our treatment of indigenous peoples already is, but that's another argument) we're not going to bother. This is the country who's longest serving Prime Ministers have both tried to keep us in the fifties - despite one of them gaining power in the 1990s.

Many of the things in the Bill of Rights were things that had been done before and during the Revolution (being forced to house troops, for example) and so people were very clear that they didn't want it to happen again and so felt the need to spell out the rights so that the new government (which the anti-Federalists were already uncomfortable with given how much power was in the executive branch) couldn't turn around and start doing the same things down the line.

@Miri, awesome! I figured out it was WWI, but didn't know what battle exactly. I'm really bad in history, the humanities suck in our schools, we study higher mathematics mostly XD

@Sarah, this was funny ))) I guess every Fereldan mage must be offended with the size of the wands, but Hogwards' mages can fly on broomsticks! (which is awesome)

[Finn] I actually thought it should've been pronounced as "seeee-rii" because it looked like a Latin name, and to sound like "k" it must've been followed by "ae". And if I recall correctly Tevinter~Byzantine Empire, and the words that came from there use the letter "k" mostly. Or so I was told when I studied Latin [/Finn] I see now that I was wrong :)

Aye, hence what I said about us - we haven't had massive violations of our rights so we don't have the same motivation to enshrine them. 

When Australia set itself up it was basically the dumb short kid in class who copied all his work from the guy next to him (England). We still made a few mistakes though :).

Oh and on-topic ANDERS stuff... um.... I think I might want to do another prompt fill for this week if people don't mind me spamming more stories. Different setting this time though :)

No, my fault.  I didn't decide she was Tevinter until after I named her.  Ceridwen is Welsh, so not proper lore friendly at all!

Oh - if you like random trivia (I love it) - Ceridwen appeared in the Tale of Taliesin.

P.S. I'm not sleeping. But I have really hard time at work. It's like the end of the world, everything is falling apart, people shout and swear and want to kill each other. I hope I will have a vacation next week, my boss says I look like a walking dead again and she doesn't want me to become completely dead :)

Coming a bit late to the promptness

Free

14 June 1941

“Comrade Andres Rebane?”

The boy answered “Yes?”

“Come with us.” The men grabbed him and marched him away.

22 June 1941

The train ground to a halt. Andres was pushed and shoved, his thin frame buffeted by the other prisoners as they scrambled to leave the cattle car. He fell to his hands and knees on the scant gravel ground. Standing up he saw an open field, a mob of men standing around each of the freight cars and guards with rifles in mustard yellow uniforms.

“The guards are very noisy” He thought.

The prisoners didn't say much, even though most were not Estonians. There piles of tools and coils of barbed wire off to one side.

One short pudgy man in civilian clothes began speaking.

“You are all enemies of the Revolution. Even so, you will do your part to serve the people.”

The guards began barking orders and Andres found himself in a column of men, five across.

22 August 1948

The thin man walked hesitantly down the street. So much of the village was destroyed. He saw the outlines of his old home and he walked faster. His mother was talking to their neighbour.

“Mama?” He called.

She looked around. She looked so old and so frail. She looked right at him and blinked in non-recognition.

“Mama, it's me. Anders.”

Her eyes opened wide. Grabbing his hand, she pulled him into their cottage. Once inside, she hugged him fiercely and began crying quietly.

15 September 1948

“Comrade Andres Rebane?”

The man answered, “Yes?”

“Come with us.”

1 October 1948

“At least I don't have to build the camp this time” He thought as he left the freight car.

The camp was already fully equipped with everything necessary for a prisoner. It had guards and dogs and barbed wire and towers. It was also a bit further south than the last one.

“Winter will be at least two or three days shorter here.”

15 April 1968

“Someone had really messed up” He thought. Exiling him to Latvia. And not just Latvia, but Mazerbe. “Finland is right across the sea.” A few days sailing and he would be free.

26 April 1968

The raft came apart with a shudder. Anders found himself alone in the dark clinging to a log far from land. He kicked his shoes off and began to swim towards what he hoped was north. When light began to creep up the sky and he could almost see the end of the log, his strength failed him.

“At least I died free, you bastards.”

I finally had time to read the stories! yay! Everyone's was so well done -- this was a wonderful prompt.

It was interesting to see him sort of jump from war to war to cold war, because like Sarah, war didn't occur to me either. I thought fiction  or something totally random like an episode of Quantum Leap.

  btw, @Sarah - I loved seeing him crossover to Hogwarts. Of course, I'm also a huge lover of the books, so it was fun to see the interaction.

Nice little Comic page and drabble... which Mae ran off with... like
whoa. Cullen also became Cullen's last name for the ease of the keeping
things straight... And, I might have watched The Crucible... just saying.

Yes, husband, he is a heathen, a horrible one.  He's at his worst when
he lays me, your plain little wife, down in the clearing just past the
well and makes love to me. He has taught me that I can feel things that
make me toss my hair loose from this damnable cap, arch my back, and dig
my nails deep into his flesh.  And once, the heat of him between my
thighs set something within me free.  It was just a spark, a flicker
from my finger tips. It was just a delusion brought on by the passion of
the moment... except that it wasn't.
"I knew it," he said. "You're like me. You have power."
To laugh! I tell him I have no power that I am but a woman, a browbeaten
minister's wife. The only power I have is that I feel in the few seconds
when he calls my name in his final throes. "No, you have it in you," he
insists. "Give me your hand. Think of something cold. The good
minister's heart will do." He smirks and I want to kiss the crease lines
it causes.
"Oh, merciful God, Anders!" I scream as he moves my hand
through the air and ice gathers at my finger tips.  He laughs and places
my chilled fingers to his lips. He tells me he can teach me more. He
says I could shoot lightning from my palms. I could heal the sick with
the slightest pass of my hands. I have to ask him something. I ask if
he's the Devil. He asks if I care. I don't. I do not.  I would love the
Devil if Anders is the Devil.
So, yes, my husband, he's a heathen, but I am too.
