I'm of two minds on this. But at the end of the day, I usually end up writing fanfic to flesh out my own canon Shep and kinda fill in the gaps left by the game. Usually dealing with her character development and emotional growth, since there's very little room in the game itself for that.
On the other hand, if I'm writing smut without plot for the kink meme, I steer well-clear of using a first name for Shep, and just kinda use a generic male or female Shepard. Using a first name is pretty jarring, both for me and for a lot of readers.
Ahh...it's different for me. I don't roleplay, so technically, I have no "canon" Shepard. When I write ME fanfic, I basically create an entire Shepard from scratch, pick the elements that I think would best serve the character I want to write and then embellishing the whole thing with all the nuances neccessary to a main character in prose fiction.
I do my best to refrain from using Shepard's first name. Usually, it only comes out during conversations where it makes sense that the other person would use his first name. This includes sex scenes as well.

He becomes the personification of the blinkered mindset that echoes the apathy of the Council and Alliance in ME1 and 2, or the way the quarian admirals use Tali's trial as a platform to campaign for their own personal causes. They're all blind and set on their own beliefs without compromise to different degrees, and Shepard himself was also blinded into thinking the Reapers has and should be at the top of everyone's agenda, but as he finds out the hard way--the world doesn't work like that.

You made it clear that he left the Systems Alliance (and had I high chance of being court-martialled), but I'm pretty sure I didn't read anything about leaving the Council. In fact, I think I read that the other species were quite thankful for the (human) sacrifices that Shephard made.
The closest (barring my end point) I think it was mentioned was this line in Chapter 1: "The Council, the Alliance—they're letting you go?" but maybe it's just me, but that sounds rather non-committal, since Spectre's are given large operational freedom anyway. I mean, presumably even Spectre's get leave at some point!
In Chapter 2; Shephard says this in regards to the IFF: "I haven't got the support of either the Council or the Alliance." but isn't that Shephard's view, and not the Council's? Since Shephard hasn't actually spoken to the Council (or referred to have spoken to the Council at least; only the System's Alliance administration that was going to court-marshal him).
You have mentioned that the Council obviously has reservations about Shephard since he was working with Cerberus, but this isn't new, they had reservations about it in ME2, and offered reinstatement regardless. Milkovich mentions ""If it were up to me, you'd have stayed court-martialled by the Council" though, is that the part you were talking about -- because that is the closest I've read about it.
I like your story, I'm just slightly confused about it

The flashbacks are there to fill you in on the backstory relevant to the on-going events in the current timeline--in this case, to show you why Shepard feels alienated from the rest of the galaxy, and becomes unsure of his place in life--not provide a factual account of Shepard's history. If you're intrigued enough, you can form your own theories. (you shouldn't find loopholes, because I *did* take the trouble to plan it out) That said, eventually, I'll address your concern. I'm just not going to reveal all my cards at this point because then where's the fun in that?
