Do you know how many cities, towns, and obscure hovels are on Earth? Yeah, about that, they're not gonna waste too much time worrying about it I wager.

From the wikipedia article:
'On 7 November 2008, former Batman Mayor Hüseyin Kalkan began looking into the possibility of suing Christopher Nolan, director of Batman Begins and The Dark Knight, and Warner Bros., distributor of the films, claiming the studios had been using "Batman", the name of the superhero, without permission from the city, and "placing the blame for a number of unsolved murders and a high female suicide rate on the psychological impact that the films' success has had on the city's inhabitants." No lawsuit has actually been filed.'

1046 is it's first mention in the Orkneyinga saga. While Kirkwall is about 1500 years old, so I guess yours is probably older.
edit: My problem is that mentions of Cumberland always make me think of sausages

Is this a case of did not do the research? There is a small city in the Orkney Islands of Scotland called Kirkwall. And given that I live about oh....200 miles? from there I could not take this game seriously if they keep that for the name of the place where I'd guess a good chunk of the game is gonna take place. Appologies if someone has already picked up on this.
I prefer John O' Groats...
