I think his official rank is Lt. Commander but when you're the CO of a ship you're called the "Captain" regardless of rank.

Posthumous promotions aren't that common. Most naval Medal of Honor recipients are posthumous, but very few receive promotions for their actions. Don't believe everything that comes out of Hollywood.

Which is why I found it strange that everyone still refered to Shepard as "Commander" instead of "Captain" when he became the CO of the Normandy in ME1. Even though he'd just been named a spectre, he still had closer ties to the Alliance than he did in ME2 (where "commander" was pretty much his nickname by then).
Like you said, CO's are refered to as Captain regardless of rank. It's a matter of respect and tradition. So why is Shepard exempted? I think it has more to do with Bioware being civilian and wanting the name "Commander Shepard" to be familiar, than any in-game reason.
