Yeah, I'm going to gather up all my plushies and have another cry in the corner if Bioware takes my fun weapons and armor away just because it's a new game.
Honestly, all that stuff is carried on the Normandy SR2 anyway, so just because it's not carried to the trial doesn't mean Shepherd won't get it back as soon as they get back to the ship.
I'm guessing the VS' response to Shepherd will depend on how you treated them on Horizon, you Paragaded, they're on your side, neutral, they could see it other way, Renegaded, they're against you.
I assume there has to be a reason to get Shepherd to Earth so they can be there when the Reapers invade, so the trial's as good a reason as any.
And the trial is probably going to serve another purpose, to have the VS nearby so they can be added to the squad right from the start from the game.
Judge: We dismiss the charges against Commander Shepherd because of Reaper Invasion.

Mind you, if given the option, I'm most likely going to Renegade my way through the trial.
Heck, if the option was presented, I wouldn't go to it at all and let them hold the trial in my absence!
Even though I play as a Paragade, I basically take the view that my Shepherd is an independent agent. They do favors for their friends, but they don't answer to any authority anymore.
Now visualizing that scene when my character witnesses start filing into the court martial.
Guard #1: A Geth, two Krogans, a Turian, a Rachni, oh man, I hope this doesn't go south for Shepherd, or we're going to be so dead.
