I always see him as a he. I am not certain, but I think he is referred to as 'he' in the game usually, rather than 'it.' But he doesn't have 'funny bumps.' Which seems to be a consistency among all female aliens (except turians, but they don't appear in game.)
Inconsistent dialogue maybe? It wouldn't be the first time a game developer has slipped up.
Technically Legion is an "it". I do know it's easier to refer to it as a "he" but it's still not actually correct. Legion has no gender, due to being a construct, this is not to be contested, I think it's reasonable to assume that something made from metal, or alloy, doesn't have a gender. As for the programs, they are software, again, software doesn't have a gender. As for Legion having a masculine appearance, that means very little, you can form metal into almost any shape, again, this doesn't mean it has a gender. A synthesised voice also means very little. All you need to do is start up "Microsoft Sam." That's a synthesised male voice, right? Correct. But that doesn't mean that my computer is male.
As I said, it's correct for people to call Legion an "it", this doesn't degrade it's worth/value, but having said that, I can understand why people call Legion a "him/he" because for the most part it makes Legion seem more human/organic, and thus "his" value is compared to that of an organic. When in actual fact, calling Legion "it" has no baring on value as a member of the party. I guess it's something to do with personal preference.
Eh, but I think there's a Legion thread for this type of discussion, no point in cluttering the thread up with random stuff that has nothing to do with Tali.

Uh, nope. They are both the same height. As it's been said before it's all down to the animations. Due to the fact that each character uses the same "bone" locations for the joints(i.e. Shoulder, elbow, fingers, etc), this means one set of animation sequences rather than an animation sequence for each and every character in the game. The physical models of Tali and Shepard are the same height. Also, it's interesting to mention that Tali have bones for four fingers and a thumb, but for obvious reasons only the bones for two fingers actually do anything. Again, all down to saving time and resources, both money and HDD space.
