So anyways when ME1 first came out I played it for about 300 hours+ or so until my disk got scratched and now it's completely unusable, this has been all in all fine except for the fact that I was still one walkthrough away from a perfect char for importing into ME2.
So my question is, if I were to buy ME1 from the Game marketplace for 1600 points or so, would my old save files which are still on my console work with this "New copy"?
Also any tips on wether I can get something in return for my scratched disk which was not my own fault (horizontaly played xbox, however I did not install)?

The save files should work...don't see why not. As long as you use the same Live profile for them.

The saves should be stored on your hard drive, so it should work.
