Why does TofSc list fifth tier spells in table 5b of the manual, when
table 3c indicates that level nine (where fifth tier spells arrive) is
well above the games level cap of 161,000 XP points (level nine is
225,000)?

May be they are cos you can find some Level5 cleric's scrolls in Durlag's Tower.

There are a lot of mods you can play with TOTSC.  Many of these will allow you to breach the xp cap and you could easily clock up millions of xp.  The problem with some of these is that while the mods themselves may be a challenge and fun to play the strength of your party means that none of the ordinary creatures in TOTSC stand a chance.

You could also get to cast 5th level spells sneakily by charming high level mage and priest npcs (Algernon's cloak alone can easily get you through the whole game if you want to exploit it).

If you have ToSC installed, the level cap is higher than pure vanilla.

Can't remember what the two caps are though.

Since I have difficulty increasing mods installed, I removed the level cap for my set up.
