I want to do as Bioware have it in the circle when Wynne is reqruited and like how Mengtzu does it in classic week to have a follower locked on the second, and one in the third position.
Additionally, I want to afterwards check if Shale was selected, because It would be strange to have the NPCs act normally if a golem is to join them in a short trip over the sea in a quite small boat.
Opening the partypicker with two new followers locked in place?

I believe you want SetFollowerState(oFollower, FOLLOWER_STATE_ACTIVELOCKED), at least during the specific quest.
To determine if Shale has been added to the party and have the othe companions react accordingly, you want to find a specific NPC; GetObjectByTag("gen00fl_shale")

Is there a function returning 1 (or TRUE) if said creature is in the party?

You could also use the party plot to determine if Shale is in the party;
if (WR_GetPlotFlag(PLT_GEN00PT_PARTY, GEN_SHALE_IN_PARTY))
It might work better this way, since you can use this to trigger any dialog needed.
