Can i get this achievement having started the game on a lower
dificulty?  If yes how soon do i have to change it by?  the reason I'm
asking is I'm starting again with my level 45 char to get this and the
level 60 ach.  I would liek to know if it's possible beforei spend too
much time on trying to earn the ach.

Yes, you should be fine to do that, just make sure you set the difficulty early. The point of no return is leaving Eden Prime - before you do, you must have set the game to your chosen difficulty.
