I think that's just a plot protection device, in order not to screw dialogues, quest triggers, etc.
So I've come to expect such things, particularly in story-driven games.

Okay, haven't really noticed that, but I'll take your word. I think entering the stealth mode would solve the distant arrow dodging problem? Not being able to fire over low cover or between bars is definately annoying though.

Okay, that's a real problem and I guess this really does defeat my previous statement. Definately enemy spellcasters scale the damage on their spells way more then players ever can. And this is indeed very unfair. Maybe we need a mod?
