Ive been playing and when never i change zones or load a saved game my spells use up one charge of their spell per day charges and spells level 5 and higher are completely depleted. Is this a normal gameplay mechanic or some sort of bug? If so can i do anything to fix it?

The game sometimes calculates your spells per day before it applies bonuses to your casting stat from items. If your natural casting stat is only 14 then that means level 5+ spells get wiped out. I think it's only supposed to be when changing modules though, I don't remember every transition and loading the game causing it but I could be wrong about the details.

You're right, only in module transitions in my experience, though IIRC, loading a save also causes it.

Thanks for the info, I switched around my equipment and found out the problem was with the shard of mental bonuses. For some reason I have 2 of them but also when I have them in my inventory the games doesnt take into account my item with higher charisma or the bonus from the shard and it gives me the spells per day as if i had 14 cha instead of the 22 it shows on my character panel.

I could be wrong, but to me, that sounds like it's working properly. In regards, to the item use, it allows for DCs, Skills and Feat based ability checks at the higher magically enhanced number, but when it comes to spells, unless its something like a Ring of Spell Storing, or a Ring of Wizardry, there are few items that you can wear or add to your inventory that actually increase your spell memorization (spell slot increases) ability and calculates your spells per day and levels of same, from your base Stat for whatever caster you are. I'm probably wrong about that these days, but that's pretty much the "old school" way and it might be one of the few things they didn't totally muck with in 3 and 3.5 changes.
