I am playing a Bard 11, Fighter 2, Eldrich Knight 3 character.  She has a perform skill level of 32.  In her underwear, to prevent any arcane spell penalties caused by armor, her newly acquired spells under her Eldrich Knight 3 levelup are paled out.  They were offered on levelup, appear in her quickspell and spellbook, but are paled out and can't be used.  Why?  These are Level 5 spells.

Maybe, or you just don't have enough charisma to gain bonus spell slots. At bard 11 EK 3, you're casting as a level 12 bard. If you look at this table, a level 13 bard can cast 0 level 5 spells per day, but knows 2 level 5 spells. If you have high enough charisma, you will get bonus spell slots per day.

Perform, by the way, doesn't have any influence on bard spellcasting, only on bard songs and inspirations.

I've seen this happen when levelling Grobnar. I THINK that if you level your character while your CHA is enhanced, you will get the spell selection, but they will become unavailable when you rest.

There are also some enchantments on items that are not continuous. For example, if you make an item with Shield Proficiency and equip a shield you couldn't otherwise carry, it will unequip during some area transitions, even though you're still carrying the item.  (In fact, you might actually find that shield in a bag).

Use Magic Item skill was notorious for this back in NWN1.  You had to unequip things before saving or count on having your inventory rearranged (to the point of losing items if your pack was full) when you reloaded.

Thanks for the replies! My character has 17 Cha, enhanced. I can't tell what she is equipping that enhances the Charisma. I, too, have noticed the blunked-out spells with Grobnar. I am disappointed because I thought that becoming an Eldrich Knight my Bard would continue to gain spells at leveling up.

She'll gain spells. MasterChanger explained it, you'll be able to cast 5th level spells if you take another Bard or EK level. Or, according to this table, you'll be able to cast one per day if you buff up your CHA to 20 with items.
