It was naive to think you could download instantly, it was your fault. It was also common sense, why would D2D let you download before the EA store? Considering that many sites have changed details for DA:O in the last few days you should of been abit wiser.

You can't really sue them, that message could easily be there for when the game is released and your lack of common sense means you interpreted it wrong, i don't think it even counts as false advertising. All you had to do was check an FAQ, you really should of been abit wiser, don't buy anything without having the facts straight otherwise you get ripped off.

Besides your the only person i've heard complain about this.

Edit: Niella the ONLY other place offering preload other than the EA store, is D2D but only for the UK edition. Its not likely the US is going to get preload anywhere other than the EA store, but keep your fingers crossed, D2D's offering preload on the 2nd of november for the UK, i have no idea why this is only for the UK, doesn't make alot of sense.

D2D in the UK is providing preload on Nov 2nd.  But they don't get to play the game till the 6th.

This clearly indicates he *did*, in fact, read the information given. Admittedly, he wasn't as smart as he could have been, but you know, I think I might have been misled as well. The ad clearly stated one specific thing. If they meant another, they should have posted what they meant, not been lazy and used a stock form which is misleading and has no basis in the facts.

That being said, I think the OP should take up the matter with D2D, and get some clarification. Being that there is no refund option for it, he should go ahead and get as much detail as possible; it might lead nowhere, but it might lead to the ad being changed so nobody else who is unfamiliar with D2D's system will be nabbed by this defiantly misleading ad.

I've gotten refunds when it says they aren't allowed.  You just have to be tactful.  A good idea would be to ask for store credit towards another purchase @ D2D.  In most cases, D2D will eat that copy of yours that you don't want because you are purchasing another product instead so they don't really lose.

Note that I said I might have been misled. Might. I was smart enough to go the hard copy route for this particular game. My normal dl mode is through Steam, when I do a dl for a game at all.

Like someone else said, that's what every order on D2D says. It's just their tag line telling you how great a download service is. Considering the same page said multiple times that this is just a preorder and the game won't be released until the third, I would have strongly questioned another part of the same page that says "download and play now!"

Firstly, it is not my responsibility to check all the other advertisements to make sure to see if they have the same "tag line" in each.  I was not interested in ordering other products.  Its like saying that if I were interested in buying a Toyota Prius from a company, that I should look to make sure that all the advertisments for their Siennas and Camrys don't have the same words in their advertisement.  It is the responsibility of a seller to ensure accurate and truthful advertisement.  Secondly, the page did not say download and play now!", it said "you will be able to immediately start downloading your bundle" which implies preload or the full game.  This is not the case as there is no immediate anything so hence it is decieving on their part as I have explained previously and in the origional post. 

Thirdly, while I am annoyed by this, I will probably put up with the wait needed even if I have to delay the game a day for download as I think the deal is excellent (even though it will kill me :blush:).  I never posted that I was inextricably upset, just irked and that I just wanted to make sure that people understood the issue so that everyone who was considering it had open eyes and point out the advertising scheme that D2D is using.  To fight it would probably cause me too much money in the long run.  I am still awaiting the response to my asking for a refund.

I think they obviously updated their ad because it could be read as being available straight away and I sypmathise...



Whoever I doubt there is not much you can do about it...



Also D2D are at least are allowing preloading.. this is on the UK site and it states you can preload on the 2nd and I guess you play it at 12:01 EST on the 3rd (in the UK we have to wait until the 6th..)

I had a similar experience with my pre-order with D2D. As they corrected (and posted) additional information about their deluxe edition offering, I decided I would take my business elsewhere. I emailed for a refund and they responded within a couple of hours indicating that they would refund the full amount. The refund didn't actually occur until about 5 days, but I think that has more to do with the credit card companies (easy to withdraw, hard to put back in policy). I'm in the US, if that helps.

This isn’t a example of false advertizing, though I admit it’s misleading. The OP might have read the entire thing, but they only paid attention to the parts they liked.



For instence, on the BioWare webpage, it used to say ‘Dragon Age: Origins, available November 3rd’ then at the bottom is said ‘Playstation version available November 12th' If someone claimed that BioWare had mislead them because the Playstasion version didn’t come out on the 3rd, they’d be wrong. (Note: This is an example. I know when the PS3 version ships.) I also run into ads all the time that say ‘Get X for free!’ and at the bottom it says ‘with purchase of Y.’



Here we have a case where the website said ‘Buy now and download immediately!’ but in a different spot it said ‘item not available until 11/3.’ Whether it be pre-load or download, they’re not obliged to give you the game until 11/3. It doesn’t matter that they plaster GET IT NOW everywhere as long as they have the actual release date on the page.



Is that unethical? I believe so.

Is it common? Yep.

They will refund your money if you send them a ticket explaining your confusion about pre-loading and indicate that the EA store is offering pre-loading. Be tactful. I got out of my D2D preorder by being nice even though I was pointing out one of D2D's shortcomings. Make sure you you let them know you were misled by the site layout, but also let them know that you now realize your error.
