I wouldn't mind Anders being a temporary companion, but I hope he isn't a permanent one. And I liked the guy. As far as I am concerned, he's still helping my Warden in Amaranthine, and will likely be benched.

Yeah, I wasn't a big fan of half of the companions being criminals either. Thinking of the potential companions who aren't leads me to believe laws in Kirkwall are a little bit like a prostitute's morals. Hrm...so the non-criminal companions would be... Aveline, Sebastian, Carver (if he lives) and possibly Fenris.

Well, you can't have bot Beth and a mage Hawke, so the mages will be three in your party. And for what we know they are only labeled as "criminal". Anders could be a Warden. And Varric isn't a criminal. He's part fo the merchant guild.
Isabela on the other hand is a pirate, true.
The thing wasn't a lot different in DAO. We have an apostate, an assassin, a qunari who have slaughtered a entire family, and, well, the two Wardens were techically traitors and criminals in Ferelden:D

PS: I saw several characters from DA;O will make an appearance in DA2, probably during the prologue cut scene only though. .

As stated before, BW wouldn't do this.
And him being in DAII wouldn't break the import save unless it ignores whether you recruited him or not. Epilogue cards aren't, from what we've seen between Origins and Awakening, canon in any meaningful way (or they play fast and loose with the implied timelines of the epilogues). The only real roadblock to him being in DAII would be an in-game death with confirmation, and that does not happen in Awakening. The worst you can do is send him with the templars and, despite Rylock's intent to have him hanged, there is no body.

He didn't get any proper character development in Awakening, and that's a big reason why it'd make sense and it'd be cool to see him again.

Tali was, Garrus is still "classified" on the ME2 website.
ETA: I think that Garrus is a special case, though, considering that he was a full blown companion in the main ME campaign AND was going by an alias within ME2, the reveal of which would have been ruined by announcing him beforehand.
