She can be killed in ME1: Yes, which means that your decisions in ME1 can still affect the outcome you get in ME2, which is a GOOD thing in my opinion. I fully support such long-term effects in your decision making, which we can NOT oversee when we make them. If this was in, and we had known about such an option during ME1 already, then it's relatively easy to see what would've happened: the whole forum and every guide telling you to save her, making it no longer your personal decision, but only a convenience decision.
She is only available to people who went through ME1: Again, this is a good thing in my opinion. Reward your old-time fans once in a while. And both Shiala and the meeting with the Consort in ME1 give good opportunity to do just that: reward your longtime fans.
Now, there will always be people who'd start complaining that old-time fans would get a big advantage over new players because of this. But, that's a matter of implementation, and can be compensated rather easily. In the case of Shiala: she's an Asari Commando, remember? Now, where have we heard about Asari Commando's before? Hmmmmm. There must be another Asari Commando in the ME universe as a potential squadie? Like... Aria?
Have the Reapers blow up Omega and let Aria barely escape alive and join Shepard, out for revenge.
So: give ME1 veterans the option to recruit Shiala, and give all players the option to recruit Aria. Give the two near identical abilities, and ME1 veterans basically end up with 2 Asari Commando's, while non-veterans get 1.
