I just noticed that two of my Xbox 360 profiles do have the picture. Neither of these was given a portrait background which suggests that may be related to why some proifiles do not have pictures. Perhaps the develoeprs could look into this.

'No background' as you call it, is still a background, if you are referring to the circle behind the character portrait. At least on the PC, I can't make the circle go away, but I can have it greyscale rather than colored. I got both types and they have updated (well not so that they are up to date, but slowly they do update): Neil Decurio's Player Profile

Technically it's a "background" but if it is the image that has a transparent background and it is superimposed upon the frame image, then it is now a layered image which could make it a bit more complex depending upon how the data is stored.
