Your error message is a new one on me, also, sorry I cannot comment upon that . . however,
You practically could have kept the 9800. The cheaper (GDDR3 RAM) of the two 440s is more or less of a sidestep, it seems:
www.gpureview.com/show_cards.php
Let's look at the other one (GDDR5 RAM):
Not much of an upgrade, but at least it's not going backwards or staying in the same spot (adding Dx11 without the real grunt to do anything with it doesn't count as an upgrade).
nVIDIA isn't making things easy on people who want to keep buying their cards whether or not they try to sell them at a good value compared to the very competitive pricing offered by AMD. At present, they are selling the GTS 450 as their gaming card, replacing the Geforce 240 after a year and a half, finally. Meanwhile, at the "Budget Gamer" spot where they were last selling the GT 220, they have three cards, all different from each other. The GT 430 and the GDDR3 version of the GT 440 are both slightly slower than should be expected from a new generation aimed at that same performance level, one about the same as the 220 was (430), and the other slightly better (slower 440). The GT 440 with GDDR5 isn't really competing at all well with the pair of Radeons in that class, the HD 5550 and HD 5570. and AMD is about to replace those anyway.
You should've gotten at least a 460 (particularly if Dx11 features intrigued you).

Thanks for the help but already reinstalled 3 times. twice from steam and once from fileplanet. I just hope the final game doesn't have these problems.
Thanks again.
Thanks again.
