From the way Merrill talks, I wonder if they just never really distinguished? She doesn't seem to really differentiate between demon and spirit beyond using the names for them occasionally. Doesn't she specifically say something like this in party banter, or am I not remembering correctly? I know she says that all spirits require caution, and how she understands that and Anders doesn't.

I take her attitude towards spirits and extend that to elves in general: they have tales about their gods, and their gods existed in this world, not the Fade (or the Beyond). The Fade is simply a different world, and the spirits inhabit it, like people do this world. And just like people, every spirit is different, some nice, some mean, some apathetic, etc. Since the two worlds are so different, the inhabitants of each don't see eye to eye with the other world's denizens, therefore any interaction is potentially dangerous. It could possibly be seen as a dangerous chemical reaction of sorts.
Regardless, the only thing that seems to separate demons from any other spirit is their drive to experience the mortal world for themselves by any means necessary. To me, Justice's desire to remain in the mortal realm wasn't completely selfish like it would be for a demon. He wished to help Anders and by doing so still cling to his purpose. He also recognizes Anders as a person and doesn't completely take over the way demons seem to in other abominations. He walks a thin line, and I don't think there really is a good definition for him between "spirit" and "demon." For Merrill, this isn't a problem, though, because she doesn't distinguish between the two.
