DX11 tessellation

Not sure if this is a bug or just a limitation, but the tessellation of paving stones in Kirkwall looks great till you see that characters feet are sinking into the stones because the tessellation is rendering above the original geometry. Most noticeable during cutscenes :/ I'll grab a screenshot of it later.

Tried changing tessellation setting from 'AMD optimized' to 'Application settings' but it had no effect in Catalyst 11.2 or 11.4. Any ideas?

AMD 6970.

it's actually from a gaming magazine but you can see the deformation quite clearly.

also similar to this one at the beginning when you flee with your family at lothering, the feet are all stuck a little bit in the hill when going upwards on DX11 only
