I'm playing nightmare, which is hard enough as it is, and my health potions keep randomly disappering in the middle of fights when I'm not using them; but need to, and I can't, because they disappear. No, the'yre not set to use by tactics...

On Nightmare, some enemies (particularly assassins) will actually steal your potions and use them. This is working as designed.
