it has 38 physical damage, +145 attack,+5% attack speed and two Rune slots which I used to increase it's critcal chance and added the rune of Devastion.

It would appear it has different stats based on whether or not he keeps it or makes you take it back. So given the right circumstances, yes it has 38 phys damage. Did not know that at the time of my post. (:
