I see a few complications in your case, and to be honest I am not sure if the problem can be solved easily; but there are a few things I want to point out and perhaps they may help.
(1) When getting a new 360 it is advisable to transfer your content licenses.
Be aware that dlcs are linked as much to your EA account as it is to your 360 and Gamertag; do not expect them to work on multiple consoles or at least not at the same time.
(2) Who owns the Gamertag that the dlc was bought with?
I think it's unadvisable to share a Gamertag myself as that could cause problems down the line, but that is with the marvelous thing called hindsight.
(3) Have you recovered the Gamertag the dlc was bought with?
You've only mentioned transferring the content on the HD and making a new Gamertag, but you do not mention recovering the shared one. Also subject to (2).
Recovering will let you use the dlc on the same 360 but your new Gamertag will not own the content. (I believe this to be the simplest solution but does depend on your actual circumstances.)
Vegglimer had some success (it would seem) with a similar problem, so you could check that thread to see if it is of any help.

I'm not exactly sure if this will be helpful, but here goes...
(1) I don't think it is possible to transfer licenses to a new gamertag/Live account (the reason for the new Live account is because my brother would not let me use his and quite frankly, I'm not sure if I want to ask why.
(2,3) The gamertag belongs to my brother. He was letting me share his because of a few multiplayer games that I play, so we can prevent the need for two Gold accounts. He still uses his gamertag regularly, which (I think) eliminates the option of recovering the gamertag for my new system.

It seems to me that the content are your brother's and not yours even if you paid for the dlcs yourself (or you bought DA and they were your codes). If they were bought or redeemed on your brother's Gamertag then the system will see them as his content and not yours.
If you had a Gamertag separate to your brother's on the same console you can use the dlc he bought. And since you no longer share the console then you won't have access to what you had on his (?) console.
I think there are two options left, though how plausible they are to you is for you to decide; I am merely suggesting them.
(1) Contact EA and possibly Microsoft to see if the content you bought can be reassigned to your new Gamertag. I would guess that even if it were possible they would require your brother's consent as well. (I would imagine this to be unlikely to be honest; probably too fiddly for them to do but ask by all means.)
(2) Buy the dlc again. The simplest solution but costs money, though I believe most hassle free way.
That exhausts all my suggestions to be honest. So unless someone else has some other insight I think those are the options available to you.
