I don't think it is Batarians, the helmet is completely wrong for it to be a Batarian.  If you look the helmet only has two eye holes whereas Baratians have 4 eyes.

They need no more than 2 eyes.

Do you think BW will tell us if they DON'T get the requisite tweets or whatever? That will be a little embarrassing if they don't meet the bar they set for themselves. I figure they'll just release it anyway (though, the bar set may not be high- I don't tweet or FB, so I don't have much perspective on the matter)

besides the apearance pack 2 info about batarians how do we know it will actually be used for all we know this might not be in batarian space

Exactly, I honestly do not know how people can look at that picture and think "oh they are Batarians".  The helmet is completely the wrong shape and style for Batarians.  I am not saying Batarians aren't going to be in the game I am just saying that guard isn't a Batarian.
