as you know, when you use an ability, its greyed out, and gets colord in like a ticking clock.

when i use backstab, wich due to my abilities should be a 5 second cooldown.  it starts ou t being about 1/3 of the way colored in, and it actuayl takes about 12 seconds for the cooldown to actually finish.
Can anyone tell me whats going on here?

Im having simalar issues with other abilities too

BTW: im on an Xbox360

could this have anything to do with the fact that my STAMINA bar looks like its wounded?
at the end of the bar it has a little clear bit after it

I'm not sure, but I believe the 5 second cooldown you are talking about, is that when you improve backstab you get -5 seconds from the total cooldown. So for example if it is 20s, the improved makes it 15s.

yes i know how it works. But backstabs normal cooldown is 10s

and instead of the animation starting where it normally does (where it shades in the icon like a clock) it seems to start 1./3 shaded in, instead of unshaded

The Backstab has a 15 sec cooldown.

When you buy the upgrade, all tooltips of the Backstab are changed to reflect the new cooldown, i.e. 10 sec cooldown.

If you use the Backstab, its cooldown animation starts with 2/3 of the shading:
Original CD - 15 seconds (3/3 of 15 seconds);
Upgraded CD - 15-5=10 seconds (2/3 of 15 seconds).

So the cooldown works as intended ;)
