I guess they make an exception in Hawke's case.

I did that and became Viscount. The Mages are not your own people - being born with the same genetic condition does not make you family.

The circle of magi did not destroy the Chantry, Anders did. A death penalty for something they weren't involved in is inexcusable.
Also Hawke is the one who helped Anders commit that crime. Even if he was tricked. If Hawke gets a pass then the circle deserves one too.
And helping the Templars punish mages for his crime just because they have magic when he does too seems hypocritical of him on an epic scale.
Not to mention the Knight-Commander of the Templars does not have the legal authority to invoke the Rite of Annulment. They need higher authorization which Meredith didn't have. Case in point, Gregior, Knight-Commander of Ferelden's Templar Order.

I sided with the templar's as a mage. The circle mages tended to have a few to many blood mages and abominations for my taste. Also, I had a grudge with the mage leader, call me petty but I wanted his head on a pike.
edit: I never helped anders, infact I ignored him since I thought he was an unstable idiot. Thats without reading the forums beforehand and knowing what he was going to do
To be fair, I also planned on killing the knight commander after it. Since she bears some responsibility for letting things get to that point.
