I got bashed for this a few months back. It doesn't say he is counciler it just says he's in a position of power and being the councilers assistent is also a position of power.

Same here. I've always thought of it as happening sometime close to Jon Grissom's funeral.
I have no problem with Udina as the default councillor, I just wished that ME2 remembered that you did, in fact, have a neutral choice ("Let's leave that one up to the politicians"). Quite frankly, they overshot on the decisions a bit (quality is ALWAYS better than quantity, this is a universal truth that, quite frankly, needs to be beaten into some people Clockwork Orange style), and once they realized that SFT import stopped BEFORE you fight Husk-Saren, they should've just had Shepard automatically say "Let's leave that one up to the politicians" and leave save/abandon the council as your epic final choice.
