Shepard's otherwise-would-be-crimes = <$10 petty thefts.
Saren's crime of attacking an established colony (not just some frontier podunk): Capital murder.
Whether or not to prosecute a Spectre for their (mis)deeds is entirely the perrogative of the Council. They are the only ones that a Spectre answers to. Saren openly attacked an Earth colony and the Council was provided proof that he was not acting in the interest of the Council, and he got sicc'd on by newly-minted Shepard. The Council was convinced that they were white-washing Shepard for merely siding with the only people who would believe him and they eased off.
Entirely the Council's prerogative. That is the nature of a Spectre's legal carte blanche powers. Odds are if you file a grievance against a Spectre, the Council is gonna side with their guy, unless you have an ironclad case of a seriously huge transgression, as was the case with Saren. You're not legally compelling them either. You're merely convincing them.
