When did this start and why?
Neither EA nor BW has any presence in my state and to the best of my knowledge shouldn't be charging me sales tax.
Tax on BW points?

"Depending on your country, region, or state, online transactions are taxed differently.
A user in Texas will see a different tax than a user in New York, or a user in Georgia, or a user in Spain.
Included
in this are VAT and GST countries, as their prices are inclusive of
tax. Modern commerce is still varied when it comes to a purchase of
digital goods."

You can see in there that they supposedly charge you what the sales tax is in your state.
Though Steam still gets away with not charging me tax in Canada...

Hrmmmm.....I'm with RGFrog here. I'm in Florida, just bought some BW points and it added 6.5% tax (my state tax rate for the county I live in). BW nor EA has any offcial presence here as far as I know. I should not be charged tax on this. I highly doubt that BW is reporting that tax to the state of Florida. I'd like an official response on this please. If you're adding tax then that money better end up with the state of Florida as it was claimed such.
Need a response on this and a refund if applicable. If theres a new tax law I'm unaware of then that's fine. Far as I know though, state tax should not be collected for us folks in Florida as there's no BW or EA presence here. Texas would be different as there is Bioware Austin.

In my state, they can only charge sales tax on "tangible personal property," so digital files are not included. However, when iTunes started to become popular, the legislature wanted their cut, so they enacted a new law to charge sales tax on certain types of digital files (photos, music, and videos). Some states assume their sales tax covers digital files, and some states don't. That being said, how could BW points be construed as a digital file, let alone tangible personal property? You don't actually receive anything. This sounds as fishy as charging sales tax on gift cards.
Edit: I found this article (http://news.cnet.com..._3-6059914.html) at CNET. It has an interactive map on the side where you can read about your state's sales tax code.

yes, it's the same here, they're not supposed to charge sales tax on digital items... in fact, EA doesn't charge sales tax like this if I go and order the digital copy of DA:2... What's worse, is now I get double taxed with the way online sales taxation is handled in OK... Thanks EA.

It's another source of income for EA. Merchants rarely accurately report tax receipts to the IRS. For all intents and purposes it's just a way to raise more DLC income for EA.
