If you think Waits can't sing, you quite simply can't have heard but a very small, and very biased sample of his songs/performances. His vocal abilities are quite extensive - he can sing in a variety of voices, and he uses different vocal effects for theatrical effect. His songs are often stories told from the perspective of a character - and he embodies that character in the performance.
Thus you have the
Gospel singer Waits
The Rocka-Billy Waits
The blues-rock Waits
The Poet Waits
The powerful balladeer Waits
The Gentle balladeer Waits
The jazz-beat poet Waits
The wild-man Waits (using his breath to produce a beat while singing - not an easy thing to do)
The demented Waits (One version)
Listening to those samples, it should be clear that what you consider "bad" singing is a vocal style used out of choise, not out of an inability to "sing better". That your ear is unaccustomed to it, and it rubs you the wrong way is one thing, but that doesn't make him a bad singer.
It's one thing to say that you don't like Waits' singing, which I can understand - not everybody does - but to say he can't sing, I think, is just factually incorrect.
