I missed Aveline's upgrade in Act 1, and don't see it on the merchant in act 2, am I screwed out of getting that act 1 upgrade?

Yep, miss it and that's it unless you reload and play back through again. I wouldn't call most of the upgrades 'critical' enough to warrant going back if you're already past the Deep Roads.
