I'm guessing that no matter what Shep will be cut-scene arrested in the beginning and it will be TIM who hands him/her over.

Why?

If you kept the collector base TIM's excuse will be "Well you see Shepard just attracts to much attention and i really need time and peace to study this base so Shepard will have to go...for humanity's sake of cause.

If you destroyed the base the well : Tim is pissed at you.

In any case i think this trial will function as a means to have Shepard removed from Cerberus.

There is one OTHER possibility:

The Trial never takes place, as the Alliance (and in co-op with the Citadel if Spectre Status is re-instated) could arrange for an "accident" that just "happens" to let Shepard "escape"....

Wouldn't even be the first time this plotline is used....

Honestly, I cannot see the VS being the one to bring Shepard in.  Consider the fact that the VS is highly sympathetic to Shepard's cause and is working to convince the Council of the Reaper threat, regardless of the interactions on Horizon... Anderson himself states this very, very clearly if you return to the Citadel and speak with him post-Horizon, which, judging by the fact that so many insist that the VS is working against you and has betrayed you, not many people have done.  The VS wouldn't agree to undermine the very cause he/she has been supporting all of these years.  Yes, they could be issued a direct order, but it wouldn't be terribly out of character at this point in the plot for either Kaidan or Ashley to be intentionally unsuccessful in their efforts to bring Shepard in.  "I wouldn't be here if I didn't think you were doing the right thing," remember?  

These are the individuals who willingly helped Shepard mutiny and steal a prototype warship because they recognized the threat the Reapers posed.  They are both dedicated to Shepard's cause even if they did not support Shepard working with Cerberus.  I do imagine that the VS is acutely aware of the fact that Shepard is essentially an independent faction at this point, however.

Regardless, I think Shepard will be imprisoned and perhaps Ashley/Kaidan will lead the jailbreak efforts (which would then be the prologue/tutorial level for the game) and they will become your first squad mate. Or, this is what I wish for.

Agreed, especially with the second point.  Bonus points if comments about potential fraternization are included during the testimony.

Depends. VS might be sent to bring Shepard in the hopes that they can convince them to give in without a fight. Sending a squad of troops is just going to provoke a fight.

That is true.  It just seems that most people anticipate that, should the VS be sent, the VS is going in with the intention of being hostile toward Shepard, which is just an utterly unbelievable notion.

But Paragon Shep indicated that he/she is ready for a trial without any convincing. Renegade Shep would send everyone to hell, even if VS was his/her LI. You know, everything provokes Renegade.

Fighting the VS arresting Shepard would make it hard to redeem yourself in the eyes of the galaxy (wich is something I guess will have to be done, this is bigger than humanity and much bigger than little Failberus). But surrendering to the VS and brought to trial to explain your actions while being in TIMmys leash, yeah, that could be a dramatic start and a neat way to summarise the two first games for new players.
