I can't really find an answer to this question, at least nothing definitive.

If one does not take on the quest "Duty" do they not get Sebastain?  I suppose I could uninstall him, but it would be easier for me if I could just not get him by not doing the quest, especially because I have another playthrough that has him that I would like to keep without having to go through and re-install just because I unistalled it this time around.

You are correct - if do not complete Duty during Act 1, you will not get him as a playable character during Act 2/3.
