It's probably more of a legal obligation for her not to say anything. I'd be suprised if Jack, or any of the other love interestes aren't in the next game. (provided they survived the suicide mission.)

Hmmm, if she's not working for Bioware then she can tell people she doesn't have the job - actors do this all the time about internet rumors that crop up. But if she IS working for Bioware... then yes she can be legally told to shut up.

unless she is working for them on different stuff and not on ME3, however sence she was a posible LI she would have to be in ME3 in some form because if you cheated on your first LI with her they go at it or something like that.... Ash vs Jax.... Credits on Jax

About Jack: Not my favourite character in ME2 but it would be a shame if she just had disappeared. One of those characters IMO that would make most sense to die in between ME2 and 3 if they wanted to get rid of her but if she's back, I am all the more happy for it.

EDIT: Better not tell her I said this or she'll bioticly kick my ass into the next spiral arm .

So, to comfort people like me: 

Garrus's voice actor being a bro in a beer commercial.

Which is actually simultaneously out of character and hilariously in character.

In NDA speak, "I can't talk about it" generally means yes, as I don't think any NDA ever would prevent someone from freely admitting they aren't working on something if they really aren't.

The very topic is OOC. It is the character "Jack" in game, not the voice actor, so what's your point?
