Technically the only real ramifications of saying yes or no come only if she is contractualy obligated to silence, which would almost definitely mean she IS in the game somehow. 



Keep in mind however that bioware is  A LOT of really high profile work for the  voice actors they hire, so she could just be staying quiet out of hope of future work. could go either way:?

Actually, no. I would like that interpretation, because Yvonne Strahovski said practically the same thing. But non-disclosure agreements don't cover just the present. It is quite possible that they've signed some clause back in 2009 saying something like "Don't say anything not cleared with us about your part in the ME games until ME3 is out". Some NDAs tend to be even more restrictive and bind you for several years after the games are out.
