Last night I was sent out at 8:30 by my wife to get peanut-free Hallowe'en candy for my son's classmates.

Since I was in Walmart anyway, I swung by the Electronics section, and what was on the shelf?  DA:O CE.

In my hand at the cash register, it was scanned:  "Are you 17?", then:  sale refused.

Denied by the Walmart inventory system.:police:  Stupid computers.

It was an exciting trip from Electronics to the cash register though.

Older gamers may remember the heft test from the 80's and 90's when the weight of the box would determine how thick the manual was.  Pure fail on that front.  DA:O is no BG from that perspective.  A few hundred grams;  max.  Magic Candle weight.

Thats happened quite a bit up north here. I think that's why they implemented it, came damn close to getting NHL10 early when the machine refused the sale.

Surely there's a legal argument that if it's on the shelf they have to sell it to you...

Technically there is but they'd rather take their chances of you sewing them than EA/BioWare crashing down on them with their all their legal might. Why? Because they have more and better lawyers than what you can afford.

Why? Before they sell the product it's theirs, if they wanted to they could refuse to sell you anything because they don't like your shirt.

I know there are rules on refusal of sale, but I don't think its so arbitrary as your shirt. I don't know enough though to say that if it's on the shelf its for sale. A clause could be that if it's not in the system they can't sell it. Either way the bastards should have just sold it for bringing your hopes up and then crashing them down.

It's purely Walmart's choice. They're not afraid of you, me or EA.

Well, I considered being a ****** about it briefly. Unfortunately I knew I was in the wrong from an ethical perspective. Granted, luckless Walmart cashier has no idea the street date is next Tuesday... but I certainly do.

What good would that do you considering that your chances of getting caught and sent to jail before leaving the store are 99%. Their scanners will pick up the game if not cleared at the main desk and their employees near the door will ensure you don't go around the scanners.

The cash register manager-person asked if there were other copies on the shelf so that they could get that dept to take them off the shelves.  In disgust, I told them the truth.  But if my pre-order mailed copy doesn't arrive early, I'm going to hit Walmart on the way home from work next Tuesday ;-)

If he wanted to get away with it, stuff the game in your shirt/jacket/pants/whatever and then buy something else with a tag on it. When you go through the door and the beeper goes off, they will most likely send you through. I havent stolen anything from a store before, but I have on many occasions bought things that made the scanner go off. Just so long as the sales clerk saw you buy something, they will most likely just wave you through, assuming it was from the tag of the item you just bought.

Well the real problem with petty theft is just that:  it's petty theft.  I have a wife, a child, a career.  Even if the chance of getting caught was say 3% ... the reward doesn't justify the risk.

As well, as I had an ethical issue just being a jerk - what are the odds I wouldn't have one stealing?

Um "how to steal" explanations here are about as kosher as "how to pirate" -- which is to say, not at all.

Let's keep this discussion within legal bounds, no?

They can at least in the US.  "No Shirt.  No Shoes. No service." is a common sign.  Errr...as long as because of your shirt = no shirt at all.  Heh.

And yes, let's NOT discuss shoplifting, OK?

I don't know about you, but where I live (The birthplace of wal-mart..so sorry..) No one wins against them. Even talking about suing them gets you a wry look and a snicker. I'm surprised they don't have their own private military by now.

This makes me hopeful that my Best Buy here will have the game when they open tuesday, instead of "when we get our shipment".

I don't see anything wrong with the discussion of hypothetical shoplifting...
But damn you for being almost lucky. Street dates are fairly often lifted by a certain store over here in the Netherlands, but I pre-ordered the Digital Deluxe Edition for Shale and Warden's Keep so I'm stuck waiting.

OMG! Reading this message I went to the gamestore here, asked a guy that knows my face as I know his if he already has DA:O. He looked in the back, came back with the CE and sold it! Even with the 10% discount that store has if you have its card!

Just played the starting cutscene of my human noble rogue! Alt-tabbed out to tell you guys! So excited! *back to playing*

That's kinda what I was thinking..I mean I get it that it shouldn't be sold..but they should be aware enough not to put it out if it shouldn't be out!

I'd really like to see this happen..the company would be sued so fast..and most likely lose.  I understand it's their  company and they have the right to withold service from anyone for any reason..but you better have a good reason oryou know how it is in those crooked courts..

Gah sorry for double post..
