In ME2, when talking to the Council/Anderson you had the choice to be re-instated as a Spectre or not.  Now that doesn't really mean much out in the Terminus Systems but i wonder if that small choice will have a big effect on the trial at the beginning of ME3.

Hackett says the Alliance plans to use Shepard a scapegoat to avoid war with the batarians, but since Spectres only answer the Council then shouldn't it be against galactic law for one to be put on trial by a paticular government?

It might seem like it might if you chose it, but, really... it won't.

Probably. I can see it happening at least. But is it set in stone that there will be a trial? Is it without a doubt confirmed by BW?

No. The Council will un-reinstate your ass so fast, the turian won't even have time to say "Ah, yes. 'Spectre'." You did exactly what Saren got his status yanked for, only you actually succeeded in wiping out the entire colony.

In theory, it should. But since the other members of the council would not want to deal with such a diplomatic disaster, and because Humanity needs to dissociate itself from Shepard as clearly as possible, the Specter status in practice would, I believe, become mostly irrelevent.

Even if your Spectre status didn't get revoked, Alliance (and Hegemony) authority supercedes that of the Citadel Council, which is only an unofficial body.

Not really, because that theory also includes the well-established precedent of the Council saying "You're not a Spectre now. No immunity for you!"

Which is equivalent to revoking the Specter status, which is not what the OP is asking.  Specters in theory answer only to the Council and only they can trial him / her. But the Council can revoke the status, which is probably what they did to Shepard.

Is it wrong for me to want Shepard to say "Screw the rules, I'm a Spectre!"

OK, nevermind.  I see the distinction you're making.  Yeah, that's true.  And yeah, I was treating the situation in terms of the more practical realities from our POV, not so much the in-world one.

I wouldn't say wrong, but it's likely futile.

Renegade interrupt in the trial. Could be interesting.

The way i see it, the game will always open with the trial but what i'm thinking is that Spectre status will determine how harsh the Alliance is on Shepard.  Considering how Saren and Tela Vasir turned out i could actually see it being potentially bad for Shepard's defense.

I think Shepard does not need a defense. I am sure the Shadow Broker can provide some information that helps Shepard out. ;)

Well the way i see, the Council will sell you out to Batarians to prevent a war. So you can kiss that Specter status down the drain or it meaning nothing really. Anyways we all know the "Trial" is a plot device to re/introduce us.

How about this... The trial is just there to show the events of what happened in ME1 and ME2. So it is there to show you what happened to the character you've imported. New characters can answer what they would have done. Just a though.

They're doing a recap comic for all platforms, so maybe that'll be the framing device, but I kinda doubt it.

The comic is only there for new games I believe.

I know that. It just seems that using the trial for that seems logical. It fits the story and can do the recap at the same time. The trial could be part of that comic.

Saren got his status yoinked because Saren had the temerity of working with the Geth, not because Saren threatened to blow up Eden Prime. If you don't believe me, I suggest you play through that whole section again and note that they only acted when Saren't 'corruption' was revealed, not for any other reason.

Which proved he attacked Eden Prime, the charge laid on him in the first place and the one the Council wanted you to substantiate.  Also, read Revelation.  Saren worries about getting his status yanked for much, much less
