I thought the flags were set correctly in ME1 if you Intimidated him? I.e. the Renegade flag is checked but the Paragon is not, whereas both are checked if you Charm him. And therefore it should be possible for the game to tell, though it might require some unorthodox scripting.

In fact, it's only a "flag" problem that BioWare did not see. So all the dialogue and scene are already in the game. The only problem is they never play because everybody is by default flag as "intimidated".

No, for the nth time, ME1 flags BOTH, and this carries over to ME2. Bioware chose to use one version over the other because that was the simplest route, and for whatever reason that was the Renegade version. Fixing it would have required patching ME1 and/or putting in a manual fix via dialogue or something, like with our choice of Councilor.

No, both are always flagged. I've imported Shepards who've Initimidated him. Makes no difference.

I don't think people should worry about it messing up ME3. Bioware knows Conrad is renegade either way in ME2, so they probably will just have ME3 ignore the flag altogether since it's broken.

Yes, they had talked about Conrad in the press and it was rather jarring and annoying to have it happen, but realistically, that's what it was: minor. Very much so. And what that translates to is "Not worth the time or money that could be spent on other, more fundamental things." And that is of course what matters in the end. Budgets and schedules are limited.
