Mind you, I, (and by extension my Shep) have always had a crush on Tali, and if I could have gone that route in the second game, I would have.

I agree that this seems a reasonable solution ... but, the same people who can't be bothered to pay attention to what games their children are playing are not going to be bothered to turn off sex scenes, so they'll still complain that the computer gaming industry isn't doing their job for them. That might be a problem, but it wouldn't be Biowares. It would basically shove down people's throat that the option for them to safeguard their children from certain content is there, but they aren't involved enough with their children to actually care.
So it's like the inate trap for people who try to bring it up. They say that the content is wrong, then Bioware informs them that they can turn it off, then they say they don't know how, then Bioware could say that if they really cared they would take the time to safeguard their children and that their negligence isn't Biowares responsibilites.
In "legal" terms it's like the get away free card. The option is there, and it also implicates the plantiff heavy for the case the defendant(Bioware) would build.

If the characters are going to be post-coital snuggling on the bed after feeling each other from the inside AND if the developers are still scared to show skin then why can't they just be naked but snuggling under the covers?
OH yeah and Bioware is so lazy Merrill doesn't even have her own unique body. They just slapped some random elf hooker body with the silliest underwear and called it a day. The body was even slightly off color from Merrill's head. LAME.

I don't see why though. What attracts the CoD audience more than explosions and awesome? Sex. Yes, big boobs and hot bodies make CoD fans drool over games.

I would disagree with that. BIOWARE has been in the forefront of same sex relationships in crpgs for a long time. EA may be gunshy and curtailing them, I don't know, but BW was the first game company I can recall making SS relationships a possibility in video games in the states. I simply think they could do better, and with no one else blazing the trail it is probably appropriate that a european company give them some cues on how to do so.
This is by no means an "anti BW" post, just a "see where you could go with it" suggestion. Bioware deserves a lot of respect for the road they have paved in the gaming industry, and I do not begrudge them that respect, but lately Faux News and similar threats seem to have caused them to keep their heads tucked, and that is a terrible shame.

There are also issues with distribution. A lot of stores don't like to carry the more adult oriented games because they don't sell as well. Plus, there are lawsuit issues and the like.
