EDIT: I'm assuming you're upgrading to the Slim, because if not, you don't have to do anything other than simply plugging your current hard drive onto the new console.

If you use a transfer cable or an MU and use the Transfer function to transfer your console's publisher data to your new hard drive, then yes it will work.
If you just copy your save files, then no it won't work. However, incase you screw up and only copy your save files, you can always load a save right before the final boss and beat the game. This will enable it for ME2 import.

Depends on how you transfer them.
If you use a transfer cable or an MU and use the Transfer function to transfer your console's publisher data to your new hard drive, then yes it will work.

thank you both for replys I can only assume that when I transfer my ME2 save files across consoles using the cable that they will be ok to import to ME3 aswell ?

It does. Using the dashboard transfer function with an MU is the only way to view the hidden game complete files and is one of the few ways to clear them from your hard drive. It's in a folder called "Publisher Data" that you can't normally view by browsing the system memory.

I don't think so. As I understand it, they're all lumped under one file. So it's all or nothing.
However you can always not transfer them and assuming you still have the pre-Saren save file you can just beat the game once on each character to create your 2 perfect end game hidden save files.
