I believe it was a necessary evil but it is still morally wrong, no matter what the cause.


 If he can prove that the Reapers were about to attack, then not only would it make the proceedings seem so much less important, then it would give an explanation for what he did. As you say, he did not comit a crime so it is a public showing so the Alliance can distance themselves from those actions. With the Reapers around, don't think that would be a priority for them

 Also wanna get across this point; Shepard did not commit genocide. The deathtoll was not entirely Batarian by Shepard's choosing (even if some Renegade Shepard's would not mind choosing their deathtoll as such)

Shepard: Ah, yes, “Cerberus” the former Alliance black ops organization allegedly gone rogue and now seeks human advancement by any means necessary.  I have dismissed that claim.

Council: Really?  Then explain that Cerberus symbol on the side of your ship.  And on the uniforms of the crew.  And the armor, and everything else on board.

Shepard: Is that the symbol for Cerberus?  I thought it was the logo for Cord-Hislop Aerospace. I make a few extra credits by providing advertising space for them.

Lawyer: Your crew are all known member of Cerberus.

Shepard: Really? My “security team” is composed mostly of nonhumans.  The fact that you believe this "Cerberus" would tolerate aliens on their ships shows just how fragile your mental state really is

Lawyer: Sir, this is a serious matter.  You stand accused of destroying an entire star system as well as its Relay…

Shepard: Everyone knows that’s impossible.  The batarians are a very charismatic and persuasive people.  They convinced the Alliance that I was responsible.  Just as they convinced you.

Lawyer: And you have an illegal, not to mention unshackled AI on board your ship.

Shepard: There's no evidence to say it's anything but a sophisticated VI. I tried to get one of those VIs that of me being sold on the Citadel. Never did receive it. So I made do.

Shepard: Look.  I believe that you believe these charges. But that doesn’t make them true.

Lawyer: ::head explodes::

The whole point of the trial is to create a scapegoat in which to avoid a war with the Batarians. (And possibly as a recap for the past two games) There is unlikely to be much of a defense at all.

This is Sheps chance to talk and present evidence for hours straight to the entire galaxy about the reapers without the council being able to muzzle him. He has a heap of evidence ranging from saren, sovereign, geth recordings, prothean artifacts collected, lack of alternative theories for prothean extinction, mass relays carbon dating, collector technology, collector DNA, collector base, remains of human reaper, lack of alternative theory behind abducted humans, recordings of derelict reaper including bits taken from it etc etc.

It's unclear exactly when the reapers will turn up but IMO Shepard has enough evidence to convince a large portion of the galaxy that something could be up with this reaper theory and that should be the basis of turning himself in.

As for the trial: all the evidence against Shep will probably be hyberbolically trumped up so as to allow us to respond with a lot of Paragon/renegade opts, much like Miri and Jacob questioning Shep in the shuttle.

In fact, the trial will most likely use evidence of every major act Shep did in all three games to orient new players as to what Shep is all about.

Alternatively, what would you as the prosecution use against Shep?

Obviously the actions taken in the Arrival DLC come to mind and the mere act of being in Cerberus (willingly or not) will likely be brought up but what else? Or can anything else be brought up since many of the acts that Shepard carried out that are even remotely questionable were carried out under Spectre immunity and such.

Also, who is going to be prosecuting Shep? Is it the Council? Alliance? A batarian delegation? Or just some hot shot ambulance chasing lawyer looking to add another victory to his inflated resume?

Crimes against the galactic species – killing the Arrival batarians, if you killed the queen, if you killed the colonist on feros

Second degree murder – Spector girl, Benezia, Jowng, Set on fire Krogan, Dantius (asari in thane’s loyalty mission), killing guards at purgatory, ect

Accomplice to murder – aiding Garrus in LM

Accessory after the fact – helping Garrus escape after LM, helping him, thane, kasumi, and jack escape

Theft – stealing the Normandy, all your cybernetic parts, the crew, Kasumi’s LM, if you kept the Cerberus data, stealing the SR1

Kidnapping – said crew, Oriana (by stopping her from going back to her dad)

Owning illegal AI – EDI, Legion(girl on citadel counted him as sheps synthetic assistant.)

Fraternization – you slept with members of your crew

Public intoxication – if you drank yourself under the table at all

Fleeing the scene of a crime – Garrus LM

Giving up military secrets – Giving Tali that data back in ME

Spying – just the meer fact you work with Quarians, Geth, and Rachni you could be giving them info. Also giving tali that data again

Facilitating the escape of criminals – you destroyed purgatory and by doing so released most of the prison population.

Slavery – you paid for Jack

Drug dealing and possession of illegal substances – if you gave that guy outside of the club on the Citadel his think drugs.

Messing with the keepers – if you scanned them

Interfering with a criminal investigation – you stopped Bailey from looking into Thane, you interrupted the cops at Liara’s home

Harboring a Yakshi – if you chose Mornith

Ok that’s all I can think of right now.

That would be awesome. I actually looked him up and the actor for that role is named Mark Sheppard. BW MUST hire him as VA for Shep's lawyer! (if such a role exists in the story...)
