1. Garrus: No political influence in either the Traverse or the Turian Hierarchy. Plus, he has nothing really better to do after the events of ME2.

2. VS: Already confirmed, but mostly because they were shafted in ME2.

3. Legion: Sure, it can play a critical role in select missions, but whats stopping it from joining Shepard after said missions? Since all Geth "share" information constantly, Legion's absence wouldn't necessarily disrupt the Geth's contribution to the war effort.

The rest are in the category of "would like to have them in ME3, but I wouldn't be bothered by their absence" -

4. Jacob: Being an honest and morally upright man, I can't see Jacob returning to Cerberus in ME3. However, he still IS a traitor in the Alliance's eyes, so he can't simply waltz back to the Alliance and pretend nothing has happened.

5. Samara: A biotic powerhouse who hopefully has the common sense to realize that the reapers are a more important threat than playing Justicar or trying to punish Shepard for any petty code he/she "broke" during ME2.
