Why is Anderson fighting with you?

I mean they protected the Council in ME1 during the attack on the Citadel, shouldn't Anderson not be allowed to fight? (If he was Councillor)

He's not a Diplomate or Councillor anymore, just an Admiral. And he was probably Shepard's Defense at the Military Trial.

On-topic:
Also remember that he's going to feature in the next novel, Deception, attempting to take action and marshall people against the Reapers. It's likely he had a plan in place at the trial to get Shepard out of there should the worst happen.
We don't see the events immediately preceeding the demo, it could be that Anderson was next to Shepard when part of the building collapsed or something.

Retribution only says Udina is Councillor, it never says that the Council was sacrificed in ME1 or that Anderson was never a Councillor. We just know that at that time in the novel (which is post-ME2), Anderson isn't councillor and we can deduce that he either stepped down or never became one, the novels do a fairly good job of not retconning any of the player's choices.
Anderson has other things to do in the plot, especially after Retribution is finished, that really prevent him from sitting idle in a council seat on the Citadel.

Cannot remember the page, but in Mass Effect: Ascension it does state that the council underwent rebuilding (suggesting that the original council was killed) and that the alliance fleet took over the Citadel fleets

Not necessarily.If you saved them,then either Anderson or Udina enter the Council,therefore it's been rebuilt either way.Sharpy33 wrote...

The human councillor was still up for debate in Ascension, yes. The Alliance fleet was helping out because Sovereign desroyed much of the Citadel fleet, regardless if you chose to protect the Destiny Ascension or not. This is hinted at by Captain Bailey as well, when he mentions why the humans have started to fill C-Sec roles. Nothing is explicitly stated about Shepard's decisions from either game, but you are free to interpret the very vague references in the novels as you wish.
