If everything goes as planned, in the trial even of you are a paragon or a renegade it sohuld be like this:

Judge: you are accused of 300000 dead batarians, how do you plead?

Shepard: I plead innocent your honor, it was cerberus fault, they brought me back from death and when i accepted the mission, two of cerberus agents drugged me, so when everything blew up I wasn't fully aware of what I did.

Judge: But you where retained in that station for two days.

Shepard: Of course, but you know, being retained takes a lot of risk like being drugged all that time and killing researchers with mechs, now i know how wilson felt.

Judge: And siding whith cerberus

Shepard: Uh, I was blackmailed, they had a picture of me with a duck and some crew members, but lets not dwell in the past, anyway they said that if didn't help them in their ludicrous mission they where going to upload it in the extranet. And....

Judge: And?!

Shepard: Uh (damn i can't think of anything else, comon you f*cking reapers what are you wating for), now i remember something else, Joker doesn't trust because you get paid more than he is and... (finally) Look at the window, those things where responsible of everything.

Judge: The pyjacks?!!!

Shepard: They have a chapter of their own, but you should look at the things that look like hands killing people...

Sorry to avoid the comedy, but I have found a legal defense that Shepard can use during the trial.

NOT GUILTY BY REASON OF NECESSITY

In legal terms, a person can argue that he/she cannot be held liable for a crime they comitted because it was by committing that crime, they were able to twart a greater harm. For example, a person can argue that they cannot be held liable for driving drunk, because they need to escape some kidnappers.

To successfully argue necessity, the accused must prove 4 conditions.

1) The harm he/she sought to avoid must outweigh the harm they committed.
2) He/She had no legal/reasonable alternative.
3) He/She ceased the conduct as soon as the danger passed.
4) He/She did not create the danger they sought to avoid.

So the argument goes like this.

1) The harm Shepard sought to avoid was the immediate extinction of all life in the galaxy which cost 300, 000 Batarian lives as opposed to trillions.
2) Due to being drugged and knocked out, there was no time to create or find a reasonable alternative to destroying the Alpha Relay.
3) Shepard ceased killing hundreds of thousands of Batarians as soon as the immediately invasion of the Reapers was thwarted, termporarily.
4) Shepard did not create the Reapers.
