I think it would be interesting if the trial was how they recapped the last 2 games. We know they are going to recap it somehow, but that it might not be a comic. So for those that import the responses are set, perhaps changing tone based on paragon/renegade scores and background, and new games involve the player choosing the testimony that becomes fact. It could even look like a series of flashbacks with the direct examination interspersed throughout.

*Charges are read, Judge asks Shep if s/he has anything to say for him/herself*

Yes your honor, I know that war with the Batarians is inevitable and I take full responsibility, however there is another way out of this and I DO have the guts!

*Pulls out a concealed pistol. holds it to chin Saren style, Reapers arrive, everyone panics, Kasumi Goto uncloaks next to Shep as she has been observing the trial and willing to use Keiji's greybox to help Shepard if need be*

Kasumi: *Doing a Saren impression* Don't kill yourself Shep! Submission is preferable to extinction! My name's Saren and I shot Nihilus before I could tell him that. What a fool I was! HAR HAR HAR

*Harbringer assumes control of the judge*

HarbJudge: You got that right Kasumi!

*The three begin laughing hysterically and imitating Saren while everyone is running for their lives and dying around them, HarbJudge clears Shep of all charges, Kasumi begins to glow*

Kasumi: KASUMiNG DIRECT CONTROL!

*Harbringer returns to judges body*

HarbJudge: Just kidding!!!

*All three start laughing again, Shep holds his/her sides, Kasumi wipes tears from her eyes, Harby slaps his knee back and forth, camera pans out to the slaughtered courtroom*

I assume thats what BW means by "darker but funnier"

Deny, to the point of being childish.

If that's an option, at least.

It's difficult to defend yourself in such trial since all your argumentation is based upon the Reapers arrival, something that nobody but Cerberus and your squad mates believe.

I suppose that when that happens I won’t be a Spectre and sure will be convicted, which seems better for the Alliance as the option of lesser opportunity cost, if what they want is to avoid a war with the batarians. Something that also benefits Cerberus, sure they can move some string to make it happen.

I’ll try to convince the jury about the reaper treat (as always), and since I expect nothing from them, I’ll wait for the Reaper attack to scape. (Jack Sparrow style)

"Ms. Shepard, you stand accused of destroying a mass relay, killing about 300,000 civilians in the process. How do you plead?"
"That's ridiculous. I admit that I happened to be in the system a few days before to extract a friend from a Batarian prison, but that's all I did, and she died a few days later from what those bastards call "interrogation". Bring forth your witnesses, will you?"
"You know perfectly well that there were no survivors of this criminal act!"
"So your charge is built on hear-say and wishful thinking on part of the Batarian government? Wow. I can't believe that the Alliance has so totally and completely lost its spine in the few years since I left the service ..."

Are we even certain that we'll have the option to speak during the trial before the reapers arrive?

Judge : You destroyed an entire planet and killed 300 000 Batarians !

Shepard : Arrival DLC was f*cked up and it doesn't allow me to make a decent choice like alert successfully the batarian ( a trial for just destroying a mass relay would be enough )

With a Widow and Adrenaline Rush.

Seriously, I don't know yet, but I know about 15 companions (and more) that Shep busted his balls to save or do dirty jobs for when they were incapable of doing them themselves over the last two games and DLCs. Many were at least witness to mitigating circumstances and things beyond hearsay, that better be present and officially entered into court testimony on Shep's behalf, and not have "other things to do"... to include: a Council Rep named Anderson, an Alliance Admiral who knows the truth, an Asari Justicar, the most powerful information broker in the galaxy (who 'mind-melded' with Shep and witnessed the Prothean extinction by vision, and happen to be present at Vigil's revelation [with another]) (and these visions can be re-created with other Asari as necessary, for testimonial purposes).

If jurisprudence fails, and we're left with the impression that it does; then at least 2 very violent Krogans, a ga' dem mercenery, the greatest thief in the galaxy, a psychotic, one woman biotic blitzkrieg, a tech-saavy Quarian and her marine sidekick, a pair of renegade Turian and Geth snipers (and [by extension perhaps] an army of orthodox Geth who know the reality of the Reaper threat), ought to have at least developed a plan to bust Shep out...whether it actually happens or not.

Not saying any of it would matter in trial, but for Shep to play the lone wolf at such a trial and his companions (if alive) are mysteriously absent and not on the witness list, well...I think it would be lame story telling. Personally, I think it would be a great plot device to pay tribute to Shep's past actions/inactions over the last two games.

My Shepard watches as the Reapers tear the roof off the courtroom midtrial. Rolls his eyes and says loudly: "Believe me now?!!!!!!" grabs a gun from a nearby dead security guard. "Time to get some Reaper sorbet".

An Alliance ships descends and lands... Huge crowd everywhere. Alliance soldiers come out of the ship and clear a path towards the building on which Shepard is to be judged.
Path is clear... Shepard starts descending on the exit-pad, with handcuffs and two marines holding his arms. In that second, a rumble starts growing up from the crowd, people rise anti-Shepard signs up and start shouting: "criminal!", "terrorist!", "you brought war upon us!"... Shepard rises his head... A person nearer to him throws something at him.
*Renegade interrupt* Shepard hurls the two marines around, swiftly paces to the guy who thrown the object at him, and stares him menacing in the eyes. Then he lets himself to be held by the marines again.
Reporters try to close up to Shepard... "Shepard, what can say about the situation in which you find yourself now, being considered a galactic hero less than 3 years ago?"
*Paragon interrupt*
"Ma'am, I take full responsibility for my actions. I did horrible things, most of which I'm not proud. I have 300.000 scars sculpted in my heart, for each soul that died in the Bahak system by my hand. I wish I wouldn't say this, but you'll see that I've done it only to postpone the arrival of the greatest threat the galaxy is yet to face. Regardless, much of the things I'm accused are true, and I'll take the full blow of my consequences."

.... later at the trial...
Judge: "Your actions, Shepard, have awarded humanity with a war against the batarians! How to you justify this?"
Shepard: - Renegade: "I killed 300.000 batarians in a couple of hours. Give me a couple of weeks and there won't be a batarian left to wage war against. A real war is about to start with the Reapers, I'd rather you worry about that war. "
-Paragon: "It was not my intention to cause a conflict with the batarians, but I've done what I've done to provide humanity a fighting chance in the real war, and I didn't do it lightly! But the reapers are coming... soon."

Judge: So you still say high that the Reapers are coming? Shepard, are you in full knowledge of the way you behave, and the reasons you adopt? An ancient machine race that will...
Loudspeaker: Sir, I am sorry to interrupt, but I have an urgent broadcast from Hackett.
Hackett: Anderson, the Reapers are here. They annihilated a quarter of our fleet with their first wave bull-running towards Earth. Get Shepard out of there, they already... *static*... Council races to... *static*... retreating to Arcturus station... * static*...
Panic builds up in the room.
