...what? If you're a civilian in wartime and you kill someone it's murder unless it's self defense. A soldier is a lot more grey and I'm not sure about soldiers. Doesn't matter because as of ME2 no one in Shep's crew counts as a soldier.
Murder doesn't give a damn about morality. Just because the victim was a "bad" person doesn't make it any less murder.
