Bioware isn't going to do a DLC that everyone can't play. It's as simple as that.
How about this - if the VS survivor is dead, you can still do the mission, but the outcome is far worse.
For example, if the mission involved the VS' old unit getting into trouble rescuing a colony, you still get the mission to rescue the unit. But, the unit is led by someone who distrusts you for your Cerberus background, and only with the VS along to smooth things over can you get them to trust you.
Without the VS, you can't successfully get the unit to follow your orders, they get into more trouble, and they all die. This leads to you also being unable to succesfully rescue all of the colonists, because forces on the planet have been substantially reduced.
At the end of the mission, you'd still get war assets, but the total number would be reduced. Say, ordinarily you'd get the VS's old unit, but they're unavialble now. And maybe the colonists have some sort of critical skill, but since fewer of them survived, they provide less EMS.
If done right, having a deceased VS would just put a different (sader, more difficult) spin on the mission.
