Which is exactly why Spectre status should be reinstated, even mandatory.
Scenario 1
Shepard: Spectre
Ashley/Kaidan: no Spectres
Result: Shepard will become CO of the Normandy since the Spectre status outranks any military rank.
Scenario 2
Shepard: Spectre
Ashley/Kaidan: Spectres
Result: Depending on "elder rights" (right word?). Since Shepard is Spectre for a longer time than Ashley/Kaidan, they should accept his/her orders - therefore, Shepard will be CO of the Normandy.
Scenario 3
Shepard: no Spectre
Ashley/Kaidan: no Spectres
Result: If Kaidan is alive, he outranks Shepard (Major > Commander). Since Shepard is no Spectre there is no way to become CO of the Normandy unless Anderson or any other Admiral orders Kaidan to obey Shepard's command.
In case if Ashley is alive, Shepard outranks her and becomes CO.
Scenario 4
Shepard: no Spectre
Ashley/Kaidan: Spectres
Result: There's no way Shepard becomes CO without the Spectre status. Either Kaidan or Ashley accept his/her role as CO out of loyalty, or they won't. There's no authority that may order them to follow Shepard.
In the end it's much easier for Shepard to become CO with his/her Spectre status. I really wonder what solution BW will use in case Shepard is no Spectre anymore.
Too bad this is not really Ashley related
I don't think the matter will come up in ME3. I am asuming after the Reaper attack the Alliance is pretty much non-exsistant besides a rag-tag resistence group on Earth. So it won't be a chain of command besides that Shepard is in charge of Shepards team.
Also I am assuming ME3 will be more guerilla warfare so it will be less about offical missions with chain of command and more about hurting the reapers everyway they can.
